When the Process Runs Smoothly
Despite their reputation, most party wall matters are relatively straightforward and proceed without significant disagreement.
Successful projects often begin with early communication. Although not required by the Act, discussing proposals with neighbours before notices are served can help establish trust and address concerns before they develop into disputes.
Once notices have been served, adjoining owners may either consent to the works or dissent and trigger the appointment of surveyor(s). Where surveyors are involved, they will typically review the proposals, assess risks and prepare a schedule of condition, recording the condition of the adjoining property before work commences.
The surveyor or surveyors will then prepare a Party Wall Award setting out how the works are to be undertaken and identifying any protective measures considered necessary. Once the award is in place, the project can generally proceed with greater certainty and clearly defined responsibilities.
